These Terms and Conditions (“Agreement”) govern the provision of heating, ventilation, and air conditioning (“HVAC”) services provided by Thermal Mechanical, a company based in Colorado Springs, CO (“Company,” “we,” “us,” or “our”) to our customers (“Customer,” “you,” or “your”). By utilizing our services, you agree to the following terms:
1. Services Provided
Thermal Mechanical offers a variety of HVAC services, including but not limited to:
- Installation
- Maintenance
- Repair
- Emergency HVAC services
The specific services requested will be detailed in the service agreement or invoice provided to you at the time of service.
2. Payment Terms
- All payments are due upon completion of services unless otherwise agreed upon.
- For service contracts or installations, partial payments or deposits may be required upfront.
- We accept payment by cash, check, or credit card. A 3% fee will be added to credit card payments.
- Any late payments may incur a late fee of 5% per month.
3. Estimates and Quotes
- Estimates provided by Thermal Mechanical are subject to change based on the actual scope of work and materials required. We will notify you of any changes to the original estimate.
- A formal quote will be provided for larger projects before any work begins. The quote is valid for [insert number of days] days from the date issued.
4. Customer Responsibilities
- You agree to provide Thermal Mechanical with access to the premises as necessary for the completion of services.
- You agree to provide accurate and complete information regarding the HVAC system or project to ensure accurate service and estimates.
5. Warranties and Guarantees
- Thermal Mechanical provides a 1 year warranty on all labor performed, and a manufacturer’s warranty on materials and equipment installed.
- The warranty does not cover damage resulting from misuse, neglect, natural disasters, or unauthorized alterations.
6. Limitation of Liability
- Thermal Mechanical will not be liable for any indirect, special, incidental, or consequential damages arising from the use of our services, including but not limited to loss of business, property damage, or personal injury.
- Our liability for any damages is limited to the amount paid by the customer for the service.
7. Force Majeure
- Thermal Mechanical shall not be liable for delays or failures in performance of its obligations if such delays or failures are caused by circumstances beyond our control, including but not limited to weather conditions, natural disasters, strikes, or power outages.
8. Termination
- Either party may terminate the agreement with written notice. If you terminate before services are completed, you agree to pay for any work completed up until that point.
9. Confidentiality
- Thermal Mechanical agrees to maintain the confidentiality of any personal information provided by you in connection with the services and will only use that information to provide the services requested.
10. Dispute Resolution
- Any disputes arising from these terms or services shall be resolved through binding arbitration in accordance with the laws of Colorado Springs, CO.
- The arbitration will be held in Colorado Springs, and any judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
11. Governing Law
- These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Colorado.
12. Amendments
- Thermal Mechanical reserves the right to amend or update these Terms and Conditions at any time. Any changes will be posted on our website or communicated directly to you.
13. Privacy Policy
- Our privacy policy is available on our website and outlines how we collect, use, and protect your personal information.
